HOW HAS THE LAW CHANGED ?

New rules concerning the use of cookies on websites came into force with the Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011.

These Regulations changed the way websites can use cookies and came into effect last year with an easing in period up to the middle of this year to allow websites to adapt to the changes.

SO WHAT HAS CHANGED ?

Basically it is all about consent.

Prior to these regulations websites were only required to inform you that they used cookies. Most web sites just included this in their terms and conditions and it was never considered important enough to require anything else to be done.

Under the new regulations you are required to give consent before a site can place cookies on your computer.

THIS IS A VERY IMPORTANT DIFFERENCE and means that we are required to actively obtain your consent to put cookies from our site onto your computer.

 

CAN I GIVE MY CONSENT BY DEFAULT ?

Technically speaking under the new regulations you must GIVE CONSENT so you cannot in theory give your consent by default.

WHAT IS A COOKIE ?

Well apart from a scrumptious biscuit it is also a small and harmless text file that is put on your computer each time you visit our site.

WHAT OTHER COOKIES ARE USED ON OUR SITE ?

If we had a shop on the high street our staff could see which part of the shop you visited and more importantly which parts you didn't visit. This would enable us to make the areas you did not visit more attractive so we could improve your shopping experience next time you came. We would also see you face to face so next time you visited we could welcome you as a returning customer.

We use a cookie to track which pages you visit on our site and if you are a returning customer. Yet again the cookie does not identify you personally only that you have or have not visited previously and which pages you viewed. Unless you delete this cookie after your visit it will stay on your machine doing no harm until next time you visit our site when the unique cookie number will simply tell us you have visited before. DO YOU USE GOOGLE COOKIES ?

We take part in something called Google analytics and yes this does mean we share the unique number in the cookie with Google so they can provide us with information that we can use to help us better understand how our customers use our site and help us to improve the customer experience for future visits.

It also helps us understand if any visitors have come to our site as a result of any adverts we might have placed online using Google ads. These are the ads you see at the right hand side of your screen (and sometimes at the top) when you do a Google search. The cookie allows Google to tell us if someone has visited our site as a direct result of clicking on one of these ads and as we have to pay for this type of advertising it means we can measure if it has been worthwhile for us to run the adverts. If we had a shop on the high street we could get customer feedback about any adverts we had run by asking customers if they had seen our advert in the newspaper or on a billboard etc and using cookies is how we measure the success or otherwise of our online advertising campaigns.

SO YOU GIVE GOOGLE MY INFORMATION ?

NO.

We do not share any information with Google or anyone else except for the anonymous number in the cookie which in no way can be linked to you or any personal information we may hold about you as a customer on our site.

The beauty of the cookie is that it can uniquely identify you for tracking purposes when you visit our site but it never knows who you actually are. You are always an anonymous visitor who can be identified only by a unique number that has no connection to your name, address or other personal information.

CAN I STOP COOKIES BEING PUT ON MY COMPUTER ?

YES YOU CAN.

If you feel strongly enough about not having cookies put on your computer and understand that this might have a detrimental effect on your use of sites on the internet, then all web browsers enable you to set your cookie preferences before you start surfing and you can alter your settings on your browser to achieve this. In fact this is probably the way that effective implementation of these regulations will eventually work. Browsers will be developed that could alert users to the kind of cookies sites use and offer them a choice as to if these cookies can be placed on their computer.
